Controlling access to the Internet by means of filtering softwarehas become a growth industry in the U.S. and elsewhere. Its usehas increased as the mandatory response to the current plagues ofsociety, namely, pornography, violence, hate, and in general,anything seen to be unpleasant or threatening. Also of potentialconcern is the possible limitation of access to Web sites thatdiscuss drugs, without distinguishing advocacy from scientificand informed analysis of addiction. With the rise of an effectivecreationist movement dedicated to the elimination of evolutionarytheory in (...) the curriculum, it is to be expected that attempts willbe made to limit access to sites presenting such theories, incertain jurisdictions in the U.S. The current preferred method ofchoice to limit access is to filter content either by blockingaccess to specific Web sites, referred to by their URLs, or byusing a large set of keywords to prevent accessing sites thatcontain one or more of these words. Another more insidious schemeis to encourage or even require every Web site to rate itscontent along a number of dimensions, including violence,language, sexual explicitness, and nudity. Then individualbrowsers can be programmed to return references only to thosesites that fall below a pre-specified profile. The dangers forfree speech inherent in such schemes will be discussed. Effortsto produce legislation in the U.S. to mandate the use offiltering or rating programs will be described, as will somerecent court decisions involving their use in libraries. (shrink)

What happens when an entire group of human beings is excluded from the definition of humanity? How is the power of language used to distort reality? What happens when a comprehensive economic plan is based on theft, brainwashing, slave labor, and murder? These and other philosophical questions about the Holocaust are contemplated in Contemporary Portraits of Auschwitz. In 1988, a group of philosophers who had survived the Holocaust, or had known people at the Auschwitz death camp, decided to found an (...) organization that would examine the philosophical implications of Shoah: the Society for the Philosophic Study of Genocide and the Holocaust. Noting that the history and the personal horror stories had been told and retold, SPSGH's founders Sander Lee, Berel Lang, and Alan Rosenberg argued that too little study had been so far devoted to the philosophy of Hitler's final solution and other genocides. Auschwitz problematized the Enlightenment concept of humanity, and other concepts. The perfection of state-sponsored and -administered mass death issued in new forms of language, moral indifference, and forgetting. Philosophy often even fails to mention the Holocaust in discussions of National Socialism. And the disaster of Auschwitz has been largely neutralized by the normalization of a "ruined" language. This volume includes essays in several areas: Witnesses and Testimonies; Morality and Ethics; Art and Poetry; History and Memory; and The Crisis of Representation. This article investigates the potential of fMRI to test assumptions about different components in models of complex cognitive tasks. If the components of a model can be associated with specific brain regions, one can make predictions for the temporal course of the BOLD response in these regions. An event‐locked procedure is described for dealing with temporal variability and bringing model runs and individual data trials into alignment. Statistical methods for testing the model are described that deal with the scan‐to‐scan correlations (...) in the errors of measurement of the BOLD signal. This approach is illustrated using a “sacrificial” ACT‐R model that involves mapping 6 modules onto 6 brain regions in an experiment from concerned with equation solving. The model's visual encoding predicted the BOLD response in the fusiform gyrus, its controlled retrieval predicted the BOLD response in the lateral inferior prefrontal cortex, and its subgoal setting predicted the BOLD response in the anterior cingulate cortex. On the other hand, its motor programming failed to predict anticipatory activation in the motor cortex, its representational changes failed to predicted the pattern of activity in the posterior parietal cortex, and its procedural component failed to predict an initial spike in caudate. The results illustrate the power of such data to direct the development of a theory of complex problem solving, both at the level of a specific task model as well as at the level of the cognitive architecture. Our aims are to set forth a multiprinciple system for selecting among clinical trials competing for limited space in an immunotherapy production facility that supplies products under investigation by scientific investigators; defend this system by appealing to justice principles; and illustrate our proposal by showing how it might be implemented. Our overarching aim is to assist manufacturers of immunotherapeutic products and other potentially breakthrough experimental therapies with the ethical task of prioritizing requests from scientific investigators when production capacity is limited.

Two arguments are critiqued here. The first is that hominin mothers “parked” their offspring; the evidence does not support that position. The second is that motherese developed to control the behavior of nonambulatory infants. However, Falk's case is stronger if we apply it to children who are already walking and more likely to be influenced by verbal information.

This article examines the sexist work experiences of a sample of women lawyers in a mediumsized midwestern city. Specifically, it focuses on reports of discrimination, gender disparagement, and sexual harassment as components of gendered systems that maintain and reinforce inequalities between men and women on the job. The relationships between these experiences, professional role orientation and structural work characteristics are explored. Respondents report lower levels of discrimination at the more visible and legally protected “front door” than on the job. For (...) the most part, private sector employees and those in token positions report higher levels of sexist behavior. Contrary to expectations, those with careerist orientations report more sexual harassment. The interrelations and implications of these findings for women's careers in the law are discussed. In response to growing concern in the 1980s about the quality of public education across the United States, a tremendous amount of energy was expended by organizations such as the Holmes Group and the Carnegie Forum to organize professional development schools or “partner schools” for teacher education. On the surface, the concept of partnering is simple; however, the practice is very costly, complex, and difficult. In _Schooling, Democracy, and the Quest for Wisdom_, Robert V. Bullough, Jr. and John R. (...) class='Hi'>Rosenberg examine the concept of partnering through various lenses and they address what they think are the major issues that need to be, but rarely are, discussed by thousands of educators in the U.S. who are involved and invested in university-public school partnerships. Robustness has long been recognized as an important parameter for evaluating game-theoretic results, but talk of ‘robustness’ generally remains vague. What we offer here is a graphic measure for a particular kind of robustness (‘matrix robustness’), using a three-dimensional display of the universe of 2 × 2 game theory. In such a measure specific games appear as specific volumes (Prisoner’s Dilemma, Stag Hunt, etc.), allowing a graphic image of the extent of particular game-theoretic effects in terms of those games. The (...) measure also allows for an easy comparison between different effects in terms of matrix robustness. It is all too rare that a scholar trained in the history of art turns his critical attention to the issues of the nature of aesthetic value and the criteria of excellence in works of art. But these issues are Rosenberg's primary concern. His method is novel for he begins by discussing the importance of tradition for value judgment. Chapters are dedicated to five important critics from the sixteenth century to the present. In each chapter Rosenberg attempts to (...) extract the distinctive features of art that have been prominent in the criticism of each of these thinkers. The second part of the book, "Quality Judgment Today," applies the principles that Rosenberg has extracted to the evaluation of master drawings from the fifteenth to the twentieth century. While aestheticians may raise doubts about the subtlety of Rosenberg's philosophic distinctions, one is impressed by his attempt to do what philosophers sometimes only talk about, viz., to show how we can rationally evaluate and compare works of art. In lieu of an abstract, here is a brief excerpt of the content:94 HUME ON THE PERCEPTION OF CAUSALITY Introduction Few issues in philosophy have generated as much debate and as little agreement as Hume's controversial theory of causality. The theory itself has been notoriously difficult to pin down, and not surprisingly empirical evidence has played a very minor role in the issue of what is meant by 'cause'. This is not, however, due to the fact that empirical tests of (...) the theory are hard to devise, but rather because such tests have usually been undertaken by experimental psychologists addressing slightly different issues and unaware of the philosophical implications of their work. However, recent signs of agreement on the overall nature of the theory (reviewed in Beauchamp and Rosenberg, chapter 1) allow a profitable integration of the theory with psychological research on the nature and importance of the perception of causal relations in conditioning. The significance of some of these experiments will be discussed later, and it will be argued that the factors Hume cited as being the essential determinants of causality, when complemented by the additional factor of the degree of contingency between the cause and the effect, correspond exactly with the factors known to affect conditioning; and therefore, that the laws of conditioning specify the properties that define causal relationships. Hume's Theory of Causality Hume was well aware of the importance of causal connections between events as a source of associations in the mind: 95 'Tis sufficient to observe, that there is no relation, which produces a stronger connexion in the fancy, and makes one idea more readily recall another, than the relation of cause and effect betwixt their objects (T II).2 In other words, if we believe a causal relationship exists between two events, then one of these events, the cause, will readily recall the other, the effect. The problem comes, of course, when we ask how it is that we know that a causal relationship exists. Obviously, a distinction must be made between causation as a physical property and causality as a mental idea. Traditionally, the following definitions have been made: causation is the physical property of one event causing another, such as one ball colliding with and causing the movement of a second ball. This property is part of the realm of mechanics and physics. Causality, on the other hand, describes the attribution by an organism of an effect to a cause. Such a distinction is supported by dictionary definitions. These two ways of thinking of what is meant by the term 'cause' are explicitly discussed by Hume. On the notion of physical causation, he says: We may define a CAUSE to be 'An object precedent and contiguous to another, and where all the objects resembling the former are plac'd in like relations of precedency and contiguity to those objects, that resemble the latter.' Of the mental idea of a causal relationship, on the other hand, he says: A CAUSE is an object precedent and contiguous to another, and so united with it, that the idea of the one determines the mind to form the idea of the other, and the impression of the one to form a more lively idea of the other. (T 170) Unfortunately, Hume was never less than imprecise in maintaining this dissociation, and often 96 he plainly confused the two definitions. Hence the academic controversy, between those who, like Kemp Smith, believe that the second definition represents a misguided attempt by Hume to analyse the causal relation on a mental level, 3 and those who see both definitions as essential (e.g. Beauchamp and Rosenberg). But surely the first definition simply represents Hume's view of causality as a philosophical relation, while the second represents his view of it as a psychological fact. And it is as much his intention to explain this fact, that ideas do not simply come into our heads for no apparent reason, but on the contrary are summoned up by preceding thoughts which they are associated, as it is to elucidate the philosophical relation. This article examines the distinction between active matter and active materials, and it offers foundational remarks toward a system of classification for active materials. Active matter is typically identified as matter that exhibits two characteristic features: self-propelling parts, and coherent dynamical activity among the parts. These features are exhibited across a wide range of organic and inorganic materials, and they are jointly sufficient for classifying matter as active. Recently, the term “active materials” has entered scientific use as a complement, supplement, (...) and extension of “active matter.” At the same time, new work in the philosophy of science has considered the problem of how to classify the products of synthetic and laboratory processes, and the extent to which the aims of classifying natural kinds compare and contrasts with the aims of classifying these synthetic kinds. In this article, I apply those considerations to the problems of classifying and characterizing active materials. In doing so, I also argue for a conception of active materials’ coherent dynamical activity as multiscale, rather than emergent, and I discuss how the special non-equilibrium status of active materials factors in to classificatory concerns. The lively debate over the constitutional foundations of judicial review has been marred by a formalism which obscures its point and value.ed from genuine issues of substance, the rival positions offer inadequate accounts of the legitimacy of judicial review; constitutional theory must regain its connection with questions of political principle and moral value. Although the critics of ultra vires have rightly emphasized the foundational role of the common law, they have misconceived its nature and implications. On the one hand, they (...) have invited the charge of judicial supremacism by marginalizing the role of legislative intent; on the other, their affirmation of absolute parliamentary sovereignty (within the context of this debate) undermines the critique of ultra vires. In substance, therefore, the rival camps occupy essentially the same ground, equally trapped by a formalism that entrenches a stark confrontation between parliamentary sovereignty and the rule of law. A conception of shared sovereignty, or interdependent sovereignties, provides a better foundation for judicial review. (shrink)

The Mental Health Act 2007 introduced Deprivation of Liberty safeguards into the Mental Capacity Act 2005 with potentially far reaching resource implications. There appears to be no scientific data regarding the prevalence of deprivation of liberty in clinical settings such as hospitals and nursing homes. We examined how many patients across a whole Trust area in Wales were subject to some lack of capacity, how well documented this was and how many were potentially deprived of their liberty. We found that (...) no patient was deprived of their liberty, but 8% lacked capacity to make either basic or complex decisions; another 5% lacked capacity to make complex decisions. Documentation was good in mental health and community directorates, but there were gaps in documentation (not practice) in the medical and surgical directorates. Routine collection of data improved documentation regarding deprivation of liberty criteria. There is a high likelihood that senior nursing staff underestimate the number of patients who lack capacity. (shrink)

Did the Greeks believe in their mythology? The answer is difficult, for “believe” means so many things… Not everyone believed that Minos continued to be a judge in Hell or that Theseus defeated the Minotaur, and they knew that poets “lie.” Nevertheless, their manner of not believing gave reason for concern, for Theseus was no less real in their eyes. It is simply necessary to “purify myth with reason’“ and to reduce the biography of the companion of Hercules to its (...) historic kernel. As for Minos, after a prodigious mental effort, Thucydides extracts the same kernel from his subject: “Of all those whom we know only by hearsay, Minos was the first to have a fleet.” The father of Phaedra, the husband of Pasiphaë is nothing more than a king who was master of the sea. The purification of the mythical by the logos is not an episode in the eternal struggle, from the beginning to Voltaire and Renan, between superstition and reason, a struggle which was the glory of Greek genius. The myth and the logos, despite Nestle, are not simple opposites like truth and error. Myth was a subject of serious reflections, and the Greeks had not yet finished with it six centuries after the Sophist movement which has been called their Aufklärung. Far from being a triumph of reason, the purging of myth by logos is a very dated program whose absurdity is surprising. Why did the Greeks make themselves unhappy for nothing by seeking to separate the wheat from the chaff instead of rejecting in one gesture the fantasy of both Theseus and the Minotaur, the very existence of a fabulous Minos as well as the implausible qualities with which the myth endows this Minos? The general consensus is that reform of medical malpractice law should be part of the health care system's overhaul. Medical malpractice litigation results in the expenditure of tens of billions annually, largely paid out of health care insurance funds and mostly paid to defendants' and plaintiffs' lawyers. By all accounts, this tort law regime ill serves the basic deterrence and compensation goals of civil liability. The causes and magnitude of these failings are disputed, and many typical reform proposals sidestep the (...) basic problems and may do more harm than good. In contrast, we advance a straightforward way to improve both deterrence and compensation. Essentially, the proposal is to remove current legal limitations on the scope of insurance subrogation that bar private and public health care insurers from “buying” the whole of their insureds' potential medical malpractice claims in exchange for lower premiums and taxes and expanded insurance coverage. Our proposal’s benefits accrue regardless of the cause and magnitude of the failings of malpractice law or the further reforms that might be adopted. (shrink)
